These Terms and Conditions apply to all visitors of the website and customers who place orders through it.
By using the website and submitting an order, you confirm that you have read and agree to these Terms and Conditions. These Terms and Conditions apply to the extent that they do not conflict with mandatory provisions of consumer protection laws.
1. Introductory Provisions
The online store is operated through the Shopify platform. However, the purchase contract is concluded between the customer and CEREBROTECH s.r.o., which acts as the seller.
These Terms and Conditions primarily regulate:

2. Customer Account and Information
When placing an order, the customer may be required to provide identification, contact, billing, and delivery information. The customer is obliged to provide only truthful, accurate, and up-to-date information.
If a customer creates a user account, they are responsible for maintaining the confidentiality of their login credentials and for all activity carried out through their account. The seller is not responsible for damage caused by a breach of this obligation by the customer.
3. Goods and Product Information
The seller strives to ensure that all product information, including descriptions, photographs, and prices, is as accurate as possible. However, the appearance of goods may slightly differ from their presentation on the website, especially depending on the technical parameters and settings of the customer’s device.
All product presentations displayed on the website are for informational purposes only. The seller reserves the right to modify the product offer, specifications, availability, and prices.
4. Orders and Conclusion of the Purchase Contract
By submitting an order, the customer makes an offer to conclude a purchase contract.
The purchase contract is concluded at the moment when the seller explicitly confirms the order. An automatic confirmation of order receipt sent by the electronic system is not considered acceptance of the offer to conclude the contract unless explicitly stated otherwise.
The seller reserves the right to refuse or cancel an order, particularly if:

the product is no longer available,

an obvious error occurred in the product price or description,

the customer provided incorrect or incomplete information,

there is reasonable suspicion of misuse of the ordering system or violation of legal regulations.
If payment for an order that cannot be accepted has already been made, the paid amount will be refunded to the customer without undue delay.
5. Prices and Payment Terms
All prices are listed on the website next to the individual products. Unless stated otherwise, prices include VAT if the seller is a VAT payer.
The price of goods does not include shipping costs or other possible charges unless explicitly stated otherwise. These costs will be displayed to the customer before the final order submission.
The seller reserves the right to change product prices, while the price valid at the moment of order submission is decisive for the customer.
The customer is required to pay the purchase price and the selected shipping fee using the payment methods available during the checkout process.
6. Delivery of Goods
Goods will be delivered to the address provided by the customer in the order or handed over using the delivery method selected during the order process.
Delivery times listed on the website are indicative unless stated otherwise. The seller is not responsible for delays caused by circumstances beyond its reasonable control, particularly the actions of carriers, force majeure, or unforeseen logistical obstacles.
For consumer contracts, the risk of damage to the goods passes to the customer only at the moment when the goods are received by the customer or by a person designated by the customer, except for the carrier.
7. Consumer Right of Withdrawal
If the customer is a consumer and the contract was concluded remotely, the customer has the right to withdraw from the contract within 14 days from the date of receiving the goods, without providing any reason, in accordance with applicable legal regulations.
If the consumer was not properly informed about the right of withdrawal, the withdrawal period may be extended by up to 12 months.

8. Complaints and Defective Performance Rights
Customer rights arising from defective performance are governed by applicable legal regulations, particularly civil and consumer protection laws valid in the Czech Republic.
The customer is required to inspect the goods upon receipt and notify the seller without undue delay of any obvious defects, shipment damage, or incorrect goods delivered.

Before submitting an order, the customer has the opportunity to learn what personal data is processed, for what purpose, on what legal basis, and what rights they have in connection with personal data protection.

The seller reserves the right to remove such content.

This does not affect rights and obligations arising from already concluded contracts.
16. Governing Law and Dispute Resolution
These Terms and Conditions and legal relations between the customer and the seller are governed by the laws of the Czech Republic, unless mandatory consumer protection regulations state otherwise.
Any disputes will be resolved before the competent courts of the Czech Republic according to applicable legal regulations.
If the customer is a consumer, they may also contact the competent alternative dispute resolution body. In the Czech Republic, this authority is typically the Czech Trade Inspection Authority (Česká obchodní inspekce).
17. Changes to the Terms and Conditions
The seller reserves the right to modify or update these Terms and Conditions as necessary. The new version becomes effective on the date it is published on the website unless stated otherwise.
Orders placed before the effective date of a new version will be governed by the Terms and Conditions valid at the time the order was submitted.
