Declaration of goods designated exclusively for laboratory research
Effective from: January 1, 2025


1. Nature of the goods offered 

CEREBROTECH s.r.o., with registered office at Světova 523/1, 180 00 Prague 8, Czech Republic, ID No.: 24581283 (hereinafter referred to as the "seller"), operates the online store https://cerebrotech.eu/sk, through which it offers for sale so-called research peptides and other chemical compounds intended exclusively for laboratory and scientific research (hereinafter referred to as "research compounds" or "goods").

All products offered in the e-shop are research compounds, i.e., chemical substances intended for use in adequately equipped laboratories by qualified personnel for the purposes of scientific analysis, in vitro studies, reference testing, and methodological research.

The goods are supplied "as is" as chemical reference standards for in vitro research; the seller does not provide a guarantee for the suitability of the goods for a specific experiment, instrument, or research outcome, beyond the mandatory consumer protection.


2. Goods are not medicines or products intended for human use

The seller expressly declares, and the buyer expressly acknowledges, that:

  • the goods ARE NOT medicinal products within the meaning of Act No. 362/2011 Coll. on medicinal products and medical devices or Act No. 378/2007 Coll. on medicinal products;

  • the goods ARE NOT food, dietary supplements, cosmetic products, or medical devices;

  • the goods ARE NOT approved by the European Medicines Agency (EMA), the State Institute for Drug Control of the Slovak Republic (ŠÚKL), the State Institute for Drug Control of the Czech Republic (SÚKL), or the US Food and Drug Administration (FDA) for human or veterinary use;

  • the goods ARE NOT intended for consumption, injection, inhalation, topical use, or any other method of application in humans or animals;

  • the seller does not declare any therapeutic, prophylactic, diagnostic, nutritional, cosmetic, or other biological effects of the goods in humans.

Any claims or information about potential biological effects of the goods, which may be included in accompanying materials, scientific literature, or social media, are solely for informational and scientific-popularization purposes and relate to the results of published in vitro or animal studies; they are not a recommendation for human use or a guide for administration.


3. Age limit and buyer eligibility 

Goods may only be purchased by persons who:

  • have reached at least 18 years of age in their country of usual residence;

  • have the legal capacity to enter into contracts;

  • purchase goods exclusively for the purpose of laboratory and scientific research, and not for resale to end consumers for consumption or for their own human use.

The seller reserves the right to require the buyer to prove their age, authorization, or purpose of use of the goods, especially by presenting an identity document, proof of employment at a scientific or academic institution, or operation of a laboratory.

The sale of goods to persons under 18 years of age is expressly PROHIBITED. Any attempt to order goods by a person under 18 years of age shall be considered a material breach of the terms and conditions; the seller is entitled to refuse or cancel such an order and to block the buyer's customer account.

The seller is also entitled to refuse, cancel, or not accept an order if there is a reasonable suspicion of the human use of the goods (especially if the buyer uses terms such as dose, cycle, injection, "how much should I inject," combinations with registered medicines, etc.), or if the delivery address is clearly unsuitable for research purposes (P.O. Box, fitness center, beauty salon, tattoo studio, etc.).


4. GPSR and safe handling, SDS

The goods are placed on the market in accordance with the product safety requirements under Regulation (EU) 2023/988 (GPSR) and the REACH/CLP chemical legislation; for each product, the seller provides the manufacturer's identification, batch number, and basic safety warnings in Slovak or Czech, depending on the country of delivery.

Before the first opening of the packaging, the buyer is obliged to familiarize themselves with the safety data sheet (SDS), which is available on the seller's website in the "Safety" section and is sent together with the order confirmation; the SDS is prepared in accordance with REACH and CLP regulations.

The buyer undertakes to handle the products exclusively in a laboratory environment with adequate equipment (fume hood, personal protective equipment, safe storage) and to dispose of all residual material and contaminated tools as hazardous waste in accordance with relevant regulations; discharge into sewage or municipal waste is prohibited.


5. Patent research exception and respect for intellectual property rights

The seller offers products exclusively as chemical reference standards intended for in vitro research and development; the offer, sale, or delivery of a product does not constitute a license for any patent, know-how, or other intellectual property rights.

Sales take place under the research exemption (the so-called Bolar exemption) to the extent permitted by applicable legal regulations; the seller does not induce the buyer to directly or indirectly infringe third-party patents and expressly disclaims such conduct.

The buyer is obliged to independently assess whether a specific molecule (e.g., Retatrutide, Tirzepatide, Semaglutide, etc.) is protected by valid patents in the country of their operation, and is responsible for ensuring that the use or further handling of the goods does not constitute a direct, indirect, or inductive infringement of third-party intellectual property rights.


6. Assumption of responsibility by the buyer and prohibition of resale

By submitting an order, the buyer expressly declares and confirms that:

  • they are aware that the goods are research material and are not intended for human or veterinary use;

  • they assume full responsibility for the manner in which the goods will be used after their receipt;

  • they assume full responsibility for assessing the legality of the import, possession, handling, and use of the goods in the country where they are located;

  • they will keep the goods safe from children and unauthorized persons;

  • shall not use the goods in a manner that would violate applicable sanctions, patent, pharmaceutical, or consumer regulations.

Without the prior written consent of the Seller, the Buyer shall not resell, distribute, repackage, alter, or remove the original labeling (including lot number, expiration date, purity, and disclaimer) of the goods, nor shall the Buyer declare or present the goods as a medicinal product, cosmetic, dietary supplement, biocidal product, or medical device.

The Buyer undertakes not to provide the goods or any part thereof to a third party for human or veterinary use, and in the event of a breach of this undertaking, shall fully compensate the Seller for any damages, penalties, and costs incurred as a result of such actions, to the maximum extent permitted by mandatory legal regulations.


7. Prohibition of Medical Advice and Rules for Third Parties

The Seller, its employees, contractors, ambassadors, or affiliate partners are not doctors, pharmacists, or other healthcare professionals and are not authorized to provide medical, pharmaceutical, dietetic, nutritional, or other healthcare advice.

Affiliate partners, ambassadors, influencers, bloggers, or other third parties must not make health or medicinal claims, dosage schemes, "before/after" photos, or claims that would create the impression that the products are intended for weight loss, performance improvement, disease treatment, or other human use in connection with the Seller's products; the Seller is not responsible for unauthorized claims by third parties and is entitled to terminate such cooperation immediately.

Before making any decisions regarding health, treatment, or nutrition, it is necessary to consult a qualified healthcare professional; no information provided on the e-shop, blog, newsletter, or social media of the Seller replaces professional medical consultation, diagnosis, or treatment.


8. Compliance with Legal Regulations and Sanctions

Before ordering goods, the Buyer is obliged to independently assess whether the import, possession, and use of the specific research compound are permitted in the country of their usual residence; the Seller is not responsible for the Buyer's violation of local regulations and the resulting sanctions.

The Buyer also declares that they are not listed on any sanctions list of the European Union, UN, OFAC, or other relevant authority, and that they will not directly or indirectly re-export or supply goods to persons and territories subject to international sanctions (especially Russia, Belarus, Iran, North Korea, Syria, and selected areas of Ukraine).

Violation of these statements is considered a material breach of contract and may be grounds for cancellation of the order, account blocking, and claiming damages by the seller.


9. Quantity Limits and Anti‑Stockpiling Clause

The seller reserves the right to limit the maximum quantity of selected products that may be supplied to a single natural or legal person, to a single delivery address, or within a defined time period (especially 30 calendar days); current limits are published on the product page and in the cart.

The seller is entitled to refuse or cancel an order and refund the purchase price paid if the order exceeds the specified limits, if repeated orders are placed to the same address by different persons, or if there is a reasonable suspicion that the goods are intended for resale contrary to this Disclaimer and the GTC.


10. Final Provisions

This Disclaimer forms an integral part of the seller's General Terms and Conditions; in case of a discrepancy between the GTC and this Disclaimer, the provision that more strictly limits the human use of the goods and protects user safety shall prevail.

The seller reserves the right to reasonably update this Disclaimer, particularly in connection with changes in legal regulations, supervisory authority practice, or product range; the current version is always published on the seller's website along with the effective date.

In the event of an unsatisfactory resolution of a complaint or other consumer dispute, the consumer-buyer has the right to submit a proposal for out-of-court dispute resolution to the competent authority (Czech Trade Inspection Authority in the Czech Republic, or Slovak Trade Inspection Authority in the Slovak Republic), in accordance with the information stated in the GTC and on the seller's website; the link to the already canceled EU ODR platform is not used.

By submitting the order, the buyer confirms that they have read, understood, and fully agree with this Disclaimer.
